Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Serenity application (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Serenity is an iOS application that provides curated soundscapes, ambient sounds, and ASMR content designed to help you sleep, calm down, and focus. The Service includes:

A library of 121 high-quality sound tracks across four categories: Sleep, Calm, Focus, and ASMR
A personalized recommendation engine based on your listening history
A sound mixer for combining multiple tracks (premium feature)
A binaural beats generator (premium feature)
Background audio playback with system Now Playing integration

3. Subscription and Pricing

3.1 Free and Premium Content

Serenity offers both free and premium content. Free users can access a selection of sounds with full playback functionality. Premium features — including the full sound library, mixer, and binaural beats — require an active subscription.

3.2 Subscription Plans

Monthly: $8.99/month, auto-renewing
Annual: $59.99/year, auto-renewing (equivalent to $5.00/month)
Lifetime: $149.99, one-time purchase

Prices are in USD and may vary by region. The actual price displayed in the App Store at the time of purchase applies.

3.3 Billing and Renewal

All purchases are processed through Apple's App Store using your Apple ID.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
You can manage and cancel subscriptions in your device's Settings → Apple ID → Subscriptions.

3.4 Free Trial

A free trial period may be offered for certain subscription plans. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

3.5 Refunds

Refunds are handled by Apple in accordance with their refund policies. To request a refund, visit reportaproblem.apple.com.

4. Use of Service

4.1 Acceptable Use

You agree not to:

Reverse engineer, decompile, or disassemble the Service
Attempt to circumvent subscription or paywall mechanisms
Redistribute, resell, or sublicense any content from the Service
Use the Service for any unlawful purpose
Interfere with or disrupt the Service or its infrastructure
Extract or download audio content from the Service for use outside the app

4.2 Content

All audio content, soundscapes, and compositions provided through the Service are either:

Generated algorithmically by the app on your device, or
Sourced from royalty-free libraries and licensed for use within the Service

Audio content is provided for personal, non-commercial use only within the Serenity app. You may not record, redistribute, or use the audio content outside of the Service.

5. Intellectual Property

The Service, including its design, code, visual elements, audio content, and branding, is owned by Serenity and protected by applicable intellectual property laws. All rights not expressly granted in these Terms are reserved.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

7. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
Serenity is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition, including sleep disorders.
We do not guarantee that the Service will help you fall asleep, reduce anxiety, or improve focus. Results vary by individual.
We do not guarantee uninterrupted or error-free operation of the Service.

8. Limitation of Liability

To the maximum extent permitted by law, Serenity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of sleep, or emotional distress, arising from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Serenity from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Modifications to Service

We reserve the right to modify, update, or discontinue any part of the Service at any time. This includes adding or removing sounds, changing features, or updating the recommendation algorithm. We will make reasonable efforts to notify you of material changes.

11. Termination

By You: You may stop using the Service at any time by canceling your subscription and deleting the app.
By Us: We may terminate or suspend your access if you violate these Terms.
Effect: Upon termination, your access to premium features will cease. Local data stored on your device will remain until you delete the app.

12. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Apple App Store Terms

These Terms are between you and Serenity, not Apple. Apple is not responsible for the Service or its content.
Apple has no obligation to provide maintenance or support for the Service.
In the event of any failure of the Service, Apple is not responsible for any refunds.
Your use of the Service must comply with the App Store Terms of Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation by contacting us at the email below.
